NYS Insurance Department Issues Opinion on co-pays Exceeding Reimbursement

The NYPTA wrote to the Superintendent of the New York State Insurance Department in June 2010 requesting an official opinion of the amount that should be collected from a beneficiary when the co-payment for physical therapy exceeded the reimbursed amount. We received a verbal opinion in July 2010 advising that the physical therapist should only collect the amount that is reimbursed by the insurance carrier. At that time, a request was made to receive the opinion in writing. The written opinion was received on January 31, 2011 and can be viewed on the NYPTA website:
