NYPT-PAC supports the following
NYPTA Legislative Plan -- 2010
1. NYPTA will resubmit two bills to address abusive practices of managed care companies related to physical therapy service and utilization practices. Utilization practices have become increasingly onerous. These bills seek to reestablish fair and appropriate utilization practices consistent with the underlying purpose of the 1996 Managed Care Reform Act. The second bill, which has been split off of the original bill, seeks to end the practice of designating physical therapists as specialist for the purpose of imposing high co-pays. (A8263 Brennan Utilization: S4321 Breslin /A8171 Cahill Co-pays)
2. NYPTA will also resubmit a bill (A.4302 (Canestrari) and S.4631 Oppenheimer), which relates to the establishment of rates of payment and delivery of health care services within the Workers' Compensation (WC) system. These bills would require the WC Board to undertake the process of examining the appropriateness of rates of payment annually, something which the Board is currently not required to do. In addition, the bills would make WC law consistent with NY State Education Department law (our practice act); thereby providing for employers and carriers the option to cover episodes of physical therapy care which occur without a referral.
3. A third bill, upgrading the educational requirements, will be resubmitted to the legislature.
4. The Advisory Panel on Legislation (APOL) will work with an appointed group of physical therapists who work in early intervention (EI) to monitor and appropriately react to legislative and budget developments as they pertain to NYS EI program.
5. NYPTA will draft legislation that closes existing loopholes in current NYS law that permit referral-for-profit (POPTS) arrangements.
NYPT-PAC opposes the following:
- Any attempt to limit our scope of practice, or having any unqualified person perform physical therapy
- Practice of physical therapy by non-licensed corporations
